New AER Water Act Authorization Procedure

On January 16, 2018, the Alberta Energy Regulator (“AER”) issued Bulletin 2018-01: OneStop – Water Act Approval Applications and Code of Practice Notifications.  

Bulletin 2018-01 provides that as of January 29, 2018, the AER will implement a new online process using the OneStop platform for submitting applications and notifications for activities requiring approval under the Water Act, including: new applications, amendment applications and code of practice notifications.  Applications for water licences will not be affected at this time.

Wetlands assessments required in conjunction with Water Act applications will also be submitted through the OneStop platform, however, wetland assessments required for Public Lands Act applications will not be affected.

January 19, 2018 will be the last day to submit Water Act approval applications and amendment applications by email.  From January 20-28, 2018, Water Act approval applications and amendment applications will not be accepted by email or through OneStop. 

The last day to submit Water Act code of practice notifications by email will be January 28, 2018.

Bulletin 2018-01 sets out a number of administrative prerequisites that must be fulfilled in order for an applicant to have access to the OneStop platform, including, for example, holding a valid business associate (BA) code and Digital Data Submissions (DDS) system account.

Bulletin 2018-01 provides dates for public training sessions in Edmonton and Calgary, with limited capacity.  Reference guides are planned to be released on January 29, 2018.
